For those who have been flagged for a potential violation of our Terms of Service and/or Conduct & Content Guidelines, we are implementing a process that we believe, over time, will evolve into a fair, thorough process in investigating violations and, ultimately, ruling on the actions following a confirmed violation.
We understand that each situation is unique, and may present completely different and new variables to consider during an investigative process. As our platform continues to scale and grow, our investigative process will continue to evolve and improve.
We also understand that suspensions/bans/locks can have an impact on creators, brands, content, and all related business, so we aim to ensure that our process is fair and thorough and completed in a timely manner.
Level of Violation
In all scenarios the Level of a Violation will be a determining factor in the initial steps of an investigation regarding if temporarily locking/suspending further content from a channel is warranted.
For example, severe violations of our conduct guidelines, including criminal/illegal acts, could result in an immediate suspension, pending an investigation. The same could apply for copyright violations, depending on the severity.
In most cases, we understand that violations can occur based on a lack of a full understanding of our terms of service and guidelines. In these circumstances, we believe educating a creator/brand is of great value as it helps prevent any future potential violations, and can lead to better content and a better experience for the creator/brand as well as they audience.
Investigative Process
On Platform: there will be a period of time allotted to gathering the evidence of a violation(s) called a Discovery period. Once this is completed, we will present this to the creator/brand and allow them time to respond.
Off Platform: there will be a period of time allotted to gathering the evidence of a violation(s) called a Discovery period, which may be longer than normal given that the violations may have occurred off our platform. Once this is completed, we will present this to the creator/brand and allow them time to respond. Off platform conduct does not have to violate the Terms related to the platform the conduct was performed on in order to violate our Terms and Guidelines, and another platform’s handling of a potential violation does not guarantee a similar outcome on our platform
It is important that your contact information is up to date, and that you are active on Disko to receive and communicate when needed regarding an investigation.
Ruling
Rulings will be communicated upon the completion of an investigation, and at that time (in most cases) confirmed violations may be informed of punishment such as a suspension, probationary period, or ban. In some cases we may allow an Appeals process
